I know they're ordinarily good-for-nothing, but maybe contact your MPP on this one.

What was this guys' name? Buford T. Justice? :lol:

Conservation Officers

Conservation Officers have powers of inspection, arrest, search and seizure under the various statutes they enforce, including the Fish and Wildlife Conservation Act and the Fisheries Act. When carrying out their duties Conservation Officers may do the following:


* Stop and inspect a vehicle, boat or aircraft;

* Ask questions relevant to the inspection;

* Inspect buildings or other places;

* Search with a warrant;

* Search without a warrant in circumstances requiring immediate action;

* Seize items related to an offence;

* Arrest anyone the Conservation Officer believes has committed, is committing, or is about to commit an offence.



See "inspect buildings and other places" (means your house) As you have registered a fishing hut he can inspect it and ask to see your license.

On one hand egistering a hut does not mean you use it. As it was after ice out asking to inspect it could be considered abusive. Go to court the CO will probably not show up. If he doesn't you win. If he does most judges will reduce the fine. The CO will have to explain why he should up at your house. If he had your new address it shows he had your new address. and the MNR should have sent you a new card.

Stranger than fiction, I know the guys are with you but I strongly suggest you contact the Ontario Conservation Officers Association talk to the guys in the know,

Try this one. every year a few of us wait until one minute after midnite on the opening of Walleye then stroll over to the bridge in the village and try our luck. this time around I was all by my lonesome great I had it all to myself had a T-rigged tube on and first cast into the rapids wham got a real nice fish about 3lbs. put it in my pail thru the tube out again and same thing another one put it in the pail and started for home. The next thing I know this officer step out of the bushes[scared the you know what out of me] asked me for my fishing license when I told him that I didn't have one well all hell broke loose seized the fish, seized my gear it almost seemed like I made his day Man that's a nite I wont forget, what a way to start the season.

This is precisly my point, if he would have checked me while fishing and he found out that the address was not changed at that time, charge me, no problem, but the Card was not in use, I was at home

Tony thanks for your generous offer,but "no thanks" and yes I will fight it in Court, I am going this morning May 27th, to Penetanguishene to set a Court Date. I'll keep you guys posted on the outcome of this.

Hi Lucannus, nope don't have one, don't need one :D :D all my adult life I could have used my native status but didn't, because there's certain things I don't buy into :oops: this time around I decided to take advantage of my age. I am 65+ and of course being a senior citizen and over 65 the province ie: MNR, states that I do not need one 8) I let the CO have his way up to a point :twisted: I got the fish back, got my rods back[sounds like a country song] :D
Did not want to side-track anyone I was trying to point out that sometimes these guy's are a little over zealous and that's what I think has happened in the ice-shack instance and I'm glad he's going to fight it.
I bet the CO in my case, will not be so quick off the mark the next time he deals with an old fart like me, well at least I hope so.
