Ok if you have a closed bottle of beer in your car/boat and you do not show any signs of intoxication and give out a good excuse ( I'm going camping and the case is taking out to much room in the car ect) the cop will most likely not do anything about it. If the cop is a bit scetch he will make you take the breathalizer just to make sure your not trying to fool him. Same in a boat if he dosent beleive you he has evey right to question your alcohol level. The best thing seriously is to just leave the beer at home/cottage. Hope this helps almontefisher !

I think if you had an unopened 6 pack or 24 and were clearly heading to a campsite this would not be an issue.

If there were open alcohol or 1 or 2 cans in the boat it might be.

But if your going to a camp site you'll have more than just booze on ya. Like food, sleeping bag etc.

Tackle boxes and beer....hmmmmmm

I believe the law is that you can be in possession of alcohol in your "vehicle" if it is in direct transportation to or from your place of residence (or camp, or cottage, etc..)

So, if you are going out for the weekend to the cottage, and stop at the beer-store first, then go to crappy tire for some stuff, then to the grocery store, then to a friends house to pick something up, then out to the cottage, you are technically in violation of the law.... You should have done that other stuff, then picked up your booze and headed off...

However, I believe the intent would be if someone had beer on their boat, and was fishing, the would obviously NOT be transporting it to the camp, therefore it can and would be taken, let alone what would happen if it was open...

Feel free to correct me on this one.. I might be mistaken.

Personally, I do not like breaking the law, so this is why it doesn't go on my boat... however, I do think that the law is stupid. A person should be able to drink whatever they like, including booze, just not be "drunk" when doing it... I do not understand why it is ok to sit in a bar and drink until you are 0.07, (0.01 below the legal limit) then get in your car and drive home... vs just having a beer while driving around... Stupid Law IMO... but wut ever... I'm not moving from Canada, nor am I going to lobby just so I can crack a cold-one on the road. The law is the law, in all of its glory.

Thanks Dan and James..And Dan...No one in Lanark goes anywhere without the beer :lol: . Now I would not and do not drink and drive ( had a girlfriend killed by a drunk driver ) or boat and drive but I do bring beer to the cottage or camp site. I am not an over indulger just a few pops with the guys.

Me I dont drink alcool when I go fishing. I should say I dont drink alchool periods. I find iresponsible the person that drink when there on the water.
The only thing thats In not shure is whenever I go fishing and I se some empty beer bottles on the shore of the river or whenever I go for that matter I pick the empty bottles and bring it home. Lets say if I get stop by the cops and they sa the bottle in the truck they could probally think I drink when I was driving but I would only tell I pick it up the bottle somewhere.

Penalties for Alchohol(sp)have gotten super strict
An theres good reasons for it
Few years back,while driving a van,I had a case behind my seat(24 less 1)
I was pulled over for burnt plate lite
Cop noticed my case,seen 1 missing and searched rest of the van for an empty(I left the empty at the camper)
I was far from impaired,did the breathalizer,passed,thought it was over
cop reached inside the slider and slide the case out and convinscated it
Wrote me a Fine for $225.00 for having open alchohol(sp)
a 24,18,12,6 are considered open if the case dosn't contain full amount
also has to be out of reach,meaning it has to be stored in the rear of any viechle
I enjoy pops as much as the next,
while boating,fishing,driving,NO.
I'm like a lad posted earlier,No Pops in my boat,or Van ,I will not lose something I busted my butt to own an enjoy for anothers stupidity

I would have fought that because that cop was wrong... an open alcohol container means an open container...If a case is in your vehicle with one out it is not an open container...period. You had an officer who was having a bad day. Now the other part about it being out of reach is true. To be classed as an open container you would need to have the cap off the bottle. Many times people transport a half bottle of booze and it is not classed as an open container. Sucks you got fined for nothing. I have had a bad day cop before, it happens.

James...in my youth it would have been a lanark few but just to old to handle the booze now...plus I have too many responsibilities now. It is amazing how a baby changes your view on things.

I did talk to Lawyers about this,they say same as you
but technicaly
the case was considered the container which houses individual bottles
to fight a $225.00 fine it would of cost me over $5000.00
hence the reason to my changes and attitudes of drinking
