I wonder if they used a spot light too? No fine for that if they did.

MEN CLAIMING METIS STATUS FINED FOR FISHERIES OFFENCES
NAPANEE - Four southern Ontario men, who unsuccessfully raised Métis rights as a defence, have been fined $550 for fishing violations in a Napanee fish sanctuary.
Robert Lloyd, 59, Edward Lloyd, 48, and Marlon Lloyd, 30, all of Northbrook, and Scott Lloyd, 32, of Scarborough, were found guilty of fishing in a fish sanctuary and were fined $100 each. They were also found guilty of unlawfully possessing fish and given a suspended sentence. In addition, Robert and Scott Lloyd were found guilty of possessing a spear within 30 metres of the water's edge and fined $75 each.
Court heard that on April 14, 2001, the Lloyds caught 18 walleye from the fish sanctuary on the Napanee River by using spears. Ministry of Natural Resources (MNR) Peterborough District conservation officers stopped the men near shore.
The four men, members of the Ontario Métis Aboriginal Association, claimed they were exercising their right to fish but Justice of the Peace Marilyn Robins ruled their claims did not meet the definition of a Métis community as set out by the Supreme Court of Canada in the Powley decision of September 2003.

Golly gee- a fine of approx. $30.00 per fish. That surely will scare off anyone from spearing fish in a sanctuary, won't it?
What a joke- probably cost the taxpayers- you and I- $5,000. to process the charges, have the C.O. appear in court, etc., then they fine those idiots less than $150. apiece?
GIVE ME A BREAK!
Sieze their truck(s), sell them, and put the $$ into stocking or habitat restoration. The only way to stop these practises is to hit the offenders
HARD!
Bloody, easy-going JP's and judges!
If they're not part of the solution - they're part of the problem!

I agree, this one really bothered me too.
The guys that caught snagging salmon on an open creek got hammered and these guys get nothing for spearing fish in a sancuary????
Where is the consistancy?
Like ccb said, these poachers need to be hit hard by the law.

well, one was an immagrant, and the other was a metis (or at least claiming to be one...)
you dont see the difference in the eyes of the court?
i wish there wasn't a difference....but our political system is very corrupt.

Are you kidding? many need to venture out of the country not for holidays but on business and see what the term "very corrupt" means.
Our country's political system has it's faults, but it is very far from being in the same ballpark as corrupt.

What bothers me most about this offence is, it took almost 4.5 years to figure out the POACHERS membership with the assoctiation did not have spearing privileges. CCB, i beleive your estimate on court costs to be a wee bit on the conservative side
. Maybe part of the sentencing could have included 1 month per fish of community service.....spearing garbage along the BOQ tributaries. These POACHERS should thank their lucky stars, that the case was not heard by a J P that has a passion for the sport or even just wetting a line from time to time. Perhaps the outcome would have been more deserving to the angling community at large.

The fines seem grossly inadequate for sure. It DOES make you wonder...
...some of these other (poacher) fines Markus has posted for our info have been significantly higher.

Wow, it's nearly the same price to spear fish in sanctuaries as it would be to hit a stocked pond. That makes a lot of sense...
