Some times it is a gray area
I have found out that if you have a skin mount on the wall that mount can be concidered part of your possesion limit.

I was always under the impression of the following...

if daily catch is 6.....you are allowed 6 in one day....(obviously)

possession is what a daily catch rate is....so another 6.....so you are allowed in possesion double your daily catch....whethere they are in a livewell....freezer....wherever...and if you continue to fish when you have that limit.....that is illegal...


So am I wrong?.. :lol: :lol:

This brings another question to mind.
Afew years back on a local fishermans show he was bass fishing in the late fall.(OOS). Although catch and release, is this not illegal??

This just blows my mind. I guess in a sense you're right on this, because I've had an completely incorrect mindset until today, and here I am someone who preaches and comes down on others that do poach. Mr. Moose just chumped out big time. :? I even went so far as to tell the other guys they were wrong after reading the regs just last week.

You see, I've got to know these things, we all do. But, in all honesty, I have only a handful of times fished south of James Bay and kept brookies, a laker and bass for the table. Never even really coming close to a daily catch limit. Up here though, I guess in a sense I have wronged, because I've kept my catch limit for a day in walleye when there is fish back home in the freezer. That said, I do have 3 special circumstances in Moose Cree territory and some of that spreads out Nationwide.

She fishes maybe once a year and I tried showing her the importance of selective harvesting of walleye at that time of year, when in fact, for a women who loves eating fish she could have kept them all legally. Afterall, for that 4 hours Bunk did the drilling and baiting constantly while she put them on the ice. But even with this example and my personally stranged circumstances with having Brenda in my life, I'd be hard pressed to know what was lawful that day or not. Sh!t I can't even get the black and white straight it seems.

And, it's still wrong, because outside of this place and my protections as an angler who often speaks angling, I should just simply know what's right. What I'm allowed to do alone.

Here's another one for the brainteasers... :lol:

Birdee and I are out on Charleston Lake....limit of 2 lakers each....

We have three fish for the table in the well....so technically one of us has our limit already......do we have to pull in one of the rods?...being that you cant keep anymore than your daily take of 2.....

Moosebunk You are trying to stay within the regs and I can see no problem with what you have in frezer as to the regs as it applys to us,your wife and children staying within the regs as they apply to us as well. Your selective harvest is to applauded as a conservationest and sportsman. Live release when you can.
Or you just going to have to eat the evence :twisted:

Well Big Sim, let us think about this for a moment. Your own story provides the reasonable grounds for searching his house. You indicate that the fisherman was observed going fishing daily bringing home a couple of salmon, each day, and that in the course of a week he would have enough fish to exceed the limit. The observation of the fisherman and the totalling of the number of fish constitutes the reasonable and probable grounds to conduct a search of the premises.

Further, do you know for a fact that they did not have a warrant when the search was conducted? Was the case dismissed when it reached court? What was the outcome of the trial :?: :?: :?:

Was the statement that this was "an illegal search" come from a Justice of the Peace or is that you own personal opinion?

No RJ. You haven't meet your combined limit and you can still fish even if you have your limit...you just can't keep more than your limit. Once that 4th one hits the livewell, you have to release them.....unless it;s a bass tourny, then you can illegally cull them.

Here's my take on that...

No.
As long as there is a license/angler on the boat without a full limit, you can keep fishing, it's similar to party hunting for deer. As long as there is an available "limit", you can keep fishing.

The only exception that I have encountered to this interpretation was a number of years ago on a frozen lake in Tweed district. There was 6 or 7 of us fishing for lakers. The CO stopped to check our licenses and while he was there buddy caught his 2nd laker and the CO ordered him to pull up his lines. He said that he'd caught his limit and had to stop fishing. This was despite the fact that those were the only two fish on the ice. I think this guy was just being a dick because that is the only instance where I have seen this.

Personally, I don't see we're there's any grey issues here. You have a daily limit and a possession limit. Don't go over either.

I'll throw another wrench in this. Lets say I live in an area that the limit is 4 like it is in northern ontario around Timmins and I come down and visit a friend that lives in Arnprior and the limit is 6. Can i legally go back home with 6?????????

Just for some confirmation, I have copied below some responses I received from Ontario's MNR to questions I submitted to them about possession limits a while back. Here are their answers:

You may not keep or harvest any fish once you have reached your catch and retain or possession limits for that species. You may, however, practice catch and release fishing for that species.

You may continue to practice catch and release fishing for a species of fish for which you have reached the possession limit. In some cases, (e.g. Conservation Licence limit for muskellunge) that limit is zero (0), but holders of Conservation licences may catch and release these fish. If you are in possession of a partial (possession) limit at your residence (e.g. 2 walleye) you may only catch and retain the balance (in your example 2 more to reach the possession limit of four).

Any person is entitled to a valid possession of a limit of fish. The holder of a full sport fishing licence or any other person may possess the legal limit of fish. The holder of a conservation sport fishing licence may only possess the conservation limits for any species.

If you give your fish to another person who may legally possess them, you are entitled to catch and retain or possess your possession limit.

:? As a group Fish-Hawk members consistently raise many good questions and issues around interpreting regulations and how to deal with illegal fishing activities. Too often, however we enter into dialogues that leave some of us more confused or acting on the well intentioned but not necessarily accurate informed opinions of contributing members. I wonder if this forum should devise a method of involving the MNR to the point of asking for their participation in this website on these types of issues and other issues that impact the fisheries and the men and women trying to fish within the confines of the often confusing regulations. Just a thought. :D

Great Point Suddsy!

I talked to one last year on these issues for about half an hour....and also asked him if he could swing by the board sometime to answer a few questions....

His answer was.....we don't have enough staff or time to properly regulate and protect the waters in this region...nevermind spend time talking about it to people on the internet...who..99% of them are honest, law abiding anglers....

so we are on our own... :lol: :lol:

Plus as we've all seen....type written word can be mistrued 100 times...
