TAKING PICTURES OUT OF SEASON ( M.N.R ANSWERS THE QUESTION )

Well I just recieved my response from our local CO out of the Aylmer District Office.

His comments were as follows:

"Accidental OOS fish that are caught, should be released Immediately. However, there is nothing wrong with snappping a quick photo if the camera is ready. If you have to fumble around for five minutes looking for your camera, then it will be determined that you are retaining the fish."

He also refered to this situation as "a gray area" and said that "how a person handles the fish and for how long will determine the course of action that a CO will take with the individual, but a CO won't bother with someone taking a quick photo if the camera is ready, followed by a speedy realease."

Like TM and Myself, I quess even the CO's can inturpurt things differently. So yes....this topic remains a "gray area".

Too funny,

Someone should compile these two responses and send a letter to the editor of the papers around here.... it is just a prime example.

I mentioned earlier that you could ask each officer and get a different interpretation, it happens at my work all the time.. To retain includes (hold) by definition.. Yes your Honour I had to hold the fish for 5 secs to get the hooks out so it could be safely released... next we will have case law indicating how long you should be able to hold a fish to get the hook or hooks out.. its splitting hairs and the folks here are responsible. Not too many posts where even in season fish arent released unharmed to fight another day. 8)

Would this be concerded breaking the Law,I was trolling for Lake trout with a lake Trout lure caught 3 MUSKIE last winter on the lower niagara and the Niagara Bar

Well LT, first of all....if you're trolling for lakers out of season....then yes! This would be illegal. :lol: :lol:

But if you were trolling for rainbows and browns and hooked that laker, then I see nothing wrong with your pic. :P

Sorry LT! I just looked at the pic again and that's a muski! Sorry, I glanced at it before and thought it was a laker. :shock:

Yes I always have the camera ready when the fish comes up you never know what kind of shot you will get.

LT,Absoloutly awsome shots!!!!!!!You have it well being so close to the bar!!!!Any big bow or brown shots???I love to fish the tribs starting at the ganny and workin my way towards the GTA down.

Are you allowed to take pictures of slot fish :roll: ,considered out of season all season,and would not measuring said fish be considered retaining that fish? :roll: Should I snap a picture before or after I measure said fish? :roll: I'd really like to know everyones opinion and Markus and the bass,I'd take a shot too,but my camera is always ready,ready before the fish is unhooked. :wink: roughrider

Well the way i see it if i catch a hugh OOS fish....topwater you take the pic while I take out the hook...and release it....LETS DROP THIS SUBJECT... :) we could go on for days...and still reach the same concultions....As Salmon said...it's the interpition by the C/O that will rule the day :D ...................Bacon and I are going to kick butt on the catfest :lol: Hey L.T.
